This sample ex parte application for a turnover order in California requests an order pursuant to Code of Civil Procedure section 699.040 ordering the judgment debtor to transfer to the levying officer either or both of the following:
Possession of the following property and documentary evidence of title to property of or a debt owed to the judgment debtor that is sought to be levied upon such as vehicles, all certificated and uncertificated securities, documents of title for real estate and promissory notes payable to the judgment debtor on the grounds that there is a need for a turnover order as the judgment creditor has been unable to fully satisfy the judgment and the judgment debtor has repeatedly refused to cooperate.
