This sample motion to amend a judgment in California to add a judgment debtor on the alter ego theory and successor company or successor corporation theory is used pursuant to Code of Civil Procedure section 187 on the grounds that there is such a unity of interest and ownership between the corporation and its equitable owner that the separate personalities of the corporation and the shareholder do not in reality exist, and that failure to do would sanction fraud or promote injustice.
