Important Change to our 30-day Money Back Guarantee as of March 16, 2024

Due to the increasing allegations of fraudulent purchase transactions involving documents specifically designated for the purposes of litigation in eviction and/or unlawful detainer proceedings, we have been forced into choosing whether to continue offering such documents at all to ANYONE, or to declare that they are NON-REFUNDABLE, and are no longer covered by the 30-day money-back guarantee.

Consequently we have decided that as of March 16, 2024 at 1:00 am, PDT this specific document, and any other single document specifically listed in the Eviction Defense Collection is hereby NON-REFUNDABLE. To determine if your proposed other documents are NON-REFUNDABLE you will need to review the list of single documents found within the description for the Eviction Defense Collection.

YOU HAVE BEEN NOTIFIED!

This sample motion in limine for California eviction after foreclosure is filed pursuant to Evidence Code sections 353 and 400 et seq., and Code of Civil Procedure section 128(a)(3)(8) and related case law.

The sample motion in limine is filed on the grounds that the evidence offered by the plaintiff is inadmissible and should be excluded as the unlawful detainer complaint fails to disclose how the plaintiff supposedly complied with Civil Code sections 2932.5, 2924 and 2934a,  and that any documents are hearsay as the facts in the documents offered by plaintiff is disputed and therefore there are no issues of fact for which any relevant evidence might be admitted at the trial.

The sample also requests that the case be dismissed as the plaintiff lacks standing as they are not the real party in interest and cannot state any valid cause of action for eviction after foreclosure.

The sample has been revised and updated as of February 2019, is 20 pages and includes,

  • Brief instructions,
  • Memorandum of points and authorities with citations to case law and statutory authority,
  • Sample declaration, and
  • Proposed order.
