This sample motion to compel satisfaction of judgment in California is filed pursuant to Code of Civil Procedure section 724.050(d) when a judgment creditor has refused to comply with a written demand for a full satisfaction of judgment within 15 days.
The sample motion requests an order compelling the judgment creditor to execute, acknowledge and file an acknowledgment of full satisfaction of judgment with the court and record a certified copy of the filed acknowledgment of satisfaction of judgment with the County Recorder of the County where the abstract of judgment was recorded. The sample also requests actual and statutory damages pursuant to Code of Civil Procedure section 724.050(e) and reasonable attorney's fees under Code of Civil Procedure section 724.080.
