Sample opposition to request for temporary restraining order in California.

This sample opposition to a request for a temporary restraining order and preliminary injunction in California contains four (4) grounds for opposition,

• (1) Plaintiffs lack standing to file this lawsuit resulting in a complete lack of authority to bring the lawsuit in the first place;  
• (2) Plaintiffs have failed to meet their burden of showing that it is reasonably probable that they will prevail on the merits;
• (3) Plaintiffs have engaged in completely inequitable conduct regarding the matters at issue in this case which demonstrates a complete lack of good faith, and
• (4) This is an ultra vires action by a non legitimate board that is acting in violation of the bylaws.
